Husband Betrays His Wife, Abandons Her In Prison

Trust is one virtue that seems to be diminishing at a dangerous spate in many families and relationships in Nigeria these days. Our metropolitan cities are churning out couples who live with each under one roof but with less than 50% of the required trust that should exists between married people.

On Wednesday, a 33-year old housewife broke down in tears at the Apapa Magistrate Court as she was sent to prison because she could not produce her husband to face the criminal charges preferred against him in the court. The woman, Mercy Nwachukwu, stood surety for her husband, Peter, in a criminal case in the court.

She signed the bail bond and assured the court that she will ensure that her husband attends the court until the matter is settled. Unknown to Mercy, her husband knew that he had a bad case and would end up in jail at the end of the trial. As a result, he quietly parked his belongings and abandoned his wife in Lagos.

He has since relocated to an unknown location. He was even said to have boldly called her on phone to tell her that he has left Lagos because his case in court could land him in prison after trial. According to Mercy, he told her to sort herself out with the complainant and the court, if she still wants to live in Lagos.

He switched his phone off and had not communicated with his family since then. After about eight adjournment and her husband still failed to show up in court, Mercy was arrested and charged to court under Section 104 of the Criminal Code Laws of Lagos State of Nigeria 2011.

She pleaded not guilty to the charges and the presiding Magistrate, Mrs O. I. Adelaja, granted her bail in the sum of N50,000 with one surety in like sum. But because she failed to meet her bail condition, Mercy was remanded in the custody of the Kirikiri prison in Lagos.

Shola Bode, 38, of Barnawa GRA, Kaduna, on Friday urged a Kaduna Upper Customary Court, to dissolve his eight-year-old marriage with his spouse, Patience.

Bode told the court that Patience had deliberately refused to “listen to him as well as work with his instructions.’’

He said that they had not been living peacefully since they got married in 2004, alleging that his wife always pack out of his house on minor issues.

“She moved out on April 4, 2006, came back after two days; moved out again on Feb. 14, 2007, and came back after 21 days and on Sept. 13, 2009, she left and is yet to return,’’ he said.

He said the marriage had yet to be blessed with a child.

Counsel to the complainant, Ahmad Ahmad, further told the Court that his client had made several efforts through his in-laws and church authority to settle the differences to no avail.

The Presiding Officer, Adamu Musa, after hearing from Bode, directed Patience to appear before the court on April 2.

A housewife in Badarawa area of Kaduna State is seeking clarification for divorce from the Sharia Court, due to persistent ridiculing and harassment by her husband because of her inability to get pregnant.

Maimuna Ibrahim had told the court that Alkasim Ibrahim, her husband had sent her away to her parents for failing to conceive nine months after marriage.

She sued Ibrahim, 26, for ridiculing her and for always referring to her as “barren.”

She also told the court that her husband had in addition to humiliating her, sent her back to her parents for them to get concoction for her to be pregnant.

Maimuna said she was in the court for redress as well as to know whether she could seek for divorce based on her husband’s action.

Ibrahim, however, denied sending her back to her parents and also denied her claimed that he was tired of living with her.

He urged the court to save his marriage by giving him time to reconcile with his wife.

The Presiding Officer, Malam Ibrahim Inuwa, warned Ibrahim against challenging the power of God as “He is the only one who gives children.”

He advised him to believe in destiny rather that blaming his wife for not conceiving and granted them 10 days to reconcile their differences.

He adjourned the case to March 8 for further hearing.

My Wife Beats Me up Almost Everyday,I Want a Divorce

A middle-aged auto mechanic on Monday asked a Mushin Grade A Customary Court to dissolve his eight-year old marriage because his wife was allegedly fond of beating him up whenever they quarrelled.

“I have never seen such a troublesome woman like my wife; she hits me with all sorts of wooden and iron objects whenever we have a quarrel and has inflicted several injuries on me. I usually don’t retaliate when she hits me.

“Her actions have been threatening my life and I can’t wait till she kills me before I save myself.

“I am tired of the marriage and I want to put an end to it,” Ibrahim Salami pleaded with the court.

Salami also accused Keji, his petty trader wife, of being an unrepentant adulterous woman who was fond of dating other men in the neighbourhood.

“My wife is a wayward woman. I can no longer vouch for her fidelity. She is always hiding the children from me and forbids them from talking to me. I believe she wants to take them to the home of one of her numerous boyfriends.”

But Keji denied the allegations, claiming that it was her husband who dated one of her friends.

“I am a responsible and Godly woman. I am not adulterous. It was Ibrahim who dated my friend in spite of my pleas. He even bragged about his shameful acts. He plays all sorts of mockery music to infuriate me in the house.”

Keji said that the divorce suit filed by Salami was a way of evading his financial responsibilities as a father.

“He wants to divorce me so that he can abandon me and the children. He doesn’t want to take care of them. He has never really cared about their welfare.

She urged the court not to grant her husband’s divorce request, adding that she was still interested in making their marriage work.

The Court President, Mr Abayomi Ipaye, advised the couple that quarrels were inevitable in marriage since it involved two people with different perception and background.

“Both of you are from different backgrounds; you have diverse opinions on various issues, therefore, you will constantly disagree.

“Disagreements breed quarrels in marriage but they can be managed with maturity and a lot of patience.”

He called on the couple to exercise endurance and humility for long lasting and blissful marriage.

Ipaye adjourned the case to March 7 for further hearing.

Man throws niece from three-storey building sentenced

An Ikeja High Court, Lagos, weekend, sentenced a middle aged man, Thank-God Ukwueze, to five years imprisonment over the death of his niece, Nkiru Iruka, eight years ago.

Ukwueze was charged for murder, allegedly committed on January 17, 2004 in Ikoyi, Lagos, under Section 319(1) of Criminal Code Cap C, Vol. 2 Laws of Lagos State in November 29, 2005.

But the court convicted him for manslaughter in accordance with Section 317 of the same law.
Trial judge, Justice Adebisi Kayode-Ogunmekan, in her judgment, held that though he was found culpable for the death of Iruka, the facts and circumstances of the case made it more appropriate to convict him of a lesser offence of manslaughter.

The Judge said: “Although the accused was charged for the offence of murder, I am of the view that lesser charge is appropriate considering the facts and circumstances of this case.

“I hereby find the accused person guilty of a lesser offence of manslaughter, which attracts the maximum sentence of a life imprisonment. I sentence the accused to five years imprisonment, which excludes the years he had spent in prison following his remand on January 19, 2004.”

The court held that though the accused person’s action caused the death of Nkiru, it might not be a deliberate action but to scare her.

According to the prosecution, the accused person, Ukwueze, allegedly killed Nkiru, who was then 22 years old, by hitting her on the head with a pestle. He was also alleged to have thrown the deceased down from a three-storey building in Ikoyi.

But in his oral evidence during trial, Ukwueze contradicted his statement when he said he did not know how the deceased slipped from the third floor of the storey building.

He said he only became aware of the incident through the noise of those who witnessed it. The trial judge held that his testimony in court was a total lie to cover up his track.

Uncovered, Graveyard Where Campus Cults bury their Victims

Since the arrest of both suspects, an investigation conducted by law enforcement agents to establish the circumstances surrounding the disappearance of Olokodana has led to the arrest of about seven people, including some commercial motorcyclists in the area.

CRIME DIGEST learnt that the motorcyclists, believed to have supplied the means of transportation used during the operation that led to the killing of Olokodana, made useful statements to the police.

They riders that they were forced at gunpoint to cooperate with the alleged cultists behind the murder and could not refuse for fear of losing their lives. Their statements paved the way for the investigation.

Perhaps unsettled by the heat generated during the investigation, some of the cultists had contacted the father of the deceased and told him via the telephone not bother to search for his son because they had given him a ‘befitting’ burial.

With this, the university authorities and the police collaborated and intensified efforts to find the body of the missing boy. Their search eventually yielded some results, as they stumbled on two graves, which were separated by a distance of about 200 metres.

Mr. Olokodana, the father of the deceased, a team of policemen, representatives of TASUED, and this reporter were at the graveyard recently.

The graveyard was discovered at Imaweje in Ijebu-Ode. Judging from the structure of the houses in the community, which is not far from TASUED, it was easy to conclude that they served as hostels for students of the institution.

Most of buildings in the vicinity of the mystery graveyard were obviously vacant and overgrown with weeds. Later, it was gathered that the fear of cult members had compelled the erstwhile occupants of the houses to desert them.

The first shallow grave was discovered behind one of the hostels. But sources said the landlord of that particular hostel, had to leave when the boys involved started causing trouble for him. Beside the hostel lies the ruins of what used to be a makeshift church.

The source said, “The residents of Imaweje are so scared that they would rather leave the area than report the activities of these boys to the police.”

About 20 metres from the deserted hostel, what looked like human bones, bleached white by sunlight, poked out of a heap of sharp sand.

When the sand was removed and the bones excavated, the father of the deceased immediately recognized his son through the clothes he wore. “This is my son. He was fond of wearing this particular trousers. He was a tall boy,” Mr. Olokodana said repeatedly.

It was obvious that the body was simply dumped on the surface and the fresh sharp sand that was used to cover up the corpse was an after-thought.

When the sand was removed, it was obvious that the body had decomposed. What remained of the deceased was a skeleton. The deceased was obviously a tall person. CRIME DIGEST observed that his ankles were missing. Apparently, his assailants had cut them off because the space could not contain his corpse.

The skull bore tell-tale evidence of a deep gash. From the look of it, one of the policemen noted, it was likely he was hit on the head with the butt of a gun. The deceased must have been bound with electric cable, which was also recovered from the shallow grave, and buried without a shirt on his body.

Also found inside the grave were two additional human bones and a spent bullet shell. The second shallow grave contained two full-length skeletons. There was a fractured skull among other human bone parts scattered around the grave. One had to be careful not to step on a human bone. But the three bodies found in this grave could not be identified by the visitors.

Mr. Olokodana, who is a medical practitioner, told CRIME DIGEST that the death of his son was a great loss to his family. He said his wife had accepted what happened in good faith.

Waving aside allegations that his son was involved in cult-related activities, Mr. Olokodana described him as an easy-going person who shunned violence in any form.

He said, “Nurudeen was tall and light complexioned. He was easy-going and did not like trouble. My son was not a cultist. His disappearance was not an easy one on us. His death is even more painful to deal with, but his mother and I are coping with it.

“We see it as God’s doing. The police are investigating and we have faith in them that justice would prevail. We’re praying that justice would prevail so my son’s death would not be in vain.”

The Ogun State Police Public Relations Officer, Muyiwa Adejobi, told CRIME DIGEST that as soon as it received information from the university authorities, the police had swung into action. He said, “We got information from the school that some boys buried their victims at Imaweje. Immediately we swung into action and recovered four bodies. One was identified, while the remaining three were not.

“Seven boys were arrested during the National Union of Road Transport Worker’s crisis. Out of the seven, two youths, namely (Adedoyin) Adegboyega and (Babatunde) Osho, were involved in the grave issue. They have all been charged to court and they are being remanded.”

He said the Ogun State Commissioner of Police and the Inspector-General of Police had granted him permission to move round the educational institutions in the state and address the students on the need to avoid violence.

He said it would be a good opportunity to strengthen their relationship with the school and the community so as to foster an enabling environment for community policing.

HORROR! Nigeria Police Tenders Live Python In Court

There was pandemonium inside a court room at the Ejigbo Magistrate Court in Lagos, as lawyers, litigants and spectators scampered for safety on Thursday when an investigating police officer, IPO, tendered a live Python as an exhibit.

Funny enough, the prosecutor, Oladejo Balogun refused to accept the snake as exhibit. He hurriedly made an oral application asking the court to order the IPO to return the Python to their custody for safety reasons. He complained that he had no place to keep it and also does not know the type of food it eats.

The policeman in turn disclosed that they were tired of keeping the snake since the arrest of the suspects last Saturday and asked the court to accept and keep it as an exhibit.

The police had brought two suspected fraudsters, Kayode Oseni, 42 and Jamiu Adeyemi, 37 along with the snake as the exhibit which they allegedly planted in a house of a complainant, Alhaji Jelili Kuku to defraud him.

It was gathered that the defendants had gone to Alhaji Kuku’s house at 14, Foursquare Street, Ikotun, Lagos and planted the snake and pretended to conducting deliverance prayers for him.

They blamed all his woes on the demon inside his house. After their arrest, they allegedly confessed to the police that they took the action to defraud the Alhaji.

They had hoped to bring the snake from where they hid it in his house while they pretended to be praying for him in order to extort money from him.

They had earlier allegedly extorted N40,000 from him to buy a ram for sacrifice, which they claimed would save his life.

However, they were unlucky as they didn't know that Alhaji Kuku saw them while they were planting the snake. He immediately invited the police who arrested them.

The defendants were docked on a two-count charge of fraud and stealing contrary to and punishable under sections 419 and 390 of the Criminal Code Cap 17 Vol. 2 Laws of Lagos State, 2003.

They pleaded not guilty to the charges. The presiding magistrate, Mrs. M. B. Folami granted them bail in the sum of N500,000 each with two sureties each in like sum.

She adjourned the matter till March 14, 2012, for further hearing and ordered the police to return the snake to their exhibit room till the next adjourned date.

Contempt: Edo AG Bags 30 Days’ Jail Term

A Federal High Court in Benin, Edo State, yesterday sentenced the Attorney General and Commissioner for Justice, Dr. Osagie Obayuwana, to one month in jail for contempt in a case pending against him before the court.

Justice Adamu Hobon, who sentenced Obayuwana, had last week adjourned till yesterday, for the hearing of committal proceedings and expressed concern over Obayuwana’s continued absence in court despite an earlier order directing him to appear in person over the case.

The court then ordered the Commissioner of Police to execute the bench warrant by effecting Obayuwana’s arrest. However, when the case came up for hearing, Obayuwana who was present in court could not escape the court order as he was ordered remanded in prison custody.

The committal proceedings were brought against the Attorney-General and the State Secretary of the Action Congress of Nigeria, A C N, Chief Osaro Idah, by the Churchgate Industries Limited over the State

Government’s alleged refusal to obey an injunction given against it in 2003 by the Federal High Court, Benin City.

The court had, after hearing a case by Churchgate, restrained the government from interfering with the management of Bendel Brewery Limited constituted by Churchgate, which was then the core investor as a result of a privatisation agreement between the State and Churchgate in 1992.

The injunction of the Federal High Court was later upheld by the Court of Appeal, Benin on October 17, 2006, which dismissed the appeal filed by the government for lacking in merit.

Court orders JTF to produce Boko Haram suspect

A Borno State High Court sitting in Maiduguri, yesterday, ordered the Military Joint Force, JTF, to produce a Boko Haram suspect, one Goni Ali, who had been detained in the last three months, within 48 hours or face the wrath of the court.

The court, presided over by Justice Alkali Wakil, gave the order while delivering a ruling on a motion in the suit number BOHC/MG/ CV/ 243M/2011, between Goni Ali and eight others.

Respondents in the suit include all the security agencies that make up JTF.

Justice Wakil expressed sadness that though JTF had earlier been served with a court order on the matter, it failed to obey the directives.

Goni was allegedly arrested in connection with the assassination of a former legislator representing Konduga Local Government Constituency by unknown gunmen in October last year.

JTF claimed that the suspect was the last person who spoke with the former lawmaker on the telephone before he was killed according to the late legislator’s call log.

However, in his ruling, Justice Wakil said: “After considering the submissions made by the learned counsel for the applicant, Mr A. Alfa, it is hereby ordered that the said Goni Ali be brought to this court within 48 hours.”

Justice Wakil further directed the respondents to charge the applicant to court, failing which the court would make further necessary orders on the matter.

Wakil remarked that the court was not happy over “the contemptuous’’ behaviour of the respondents as all the “parties have been served,’’ and ‘’there is proof of service but none of them had the courtesy to even write or send a representative to state why they were not present in court.”
